What iS AN INDICTABLE CRIME, also known as a felony?
An indictable crime is distinguishable from a disorderly persons offense (misdemeanor) in that for a felony, you can go to state prison if convicted.
Felonies/Indictable crimes are heard in the Superior Court in the County that the alleged offense took place. Once there, you have the right to attorney and the right to have a trial before a jury of your peers.
Criminal matters can be delayed for years and can often feel like they are taking over your life and that you are losing control emotionally. For these offenses, it is important to hire someone with experience because your freedom can be at risk.
At the outset, your case will either be put on a Summons (ticket form) or a Warrant that requires your arrest and detention. For some, the prosecutor may file a motion to detain you and hold you in jail indefinitely until a trial occurs. However, in most cases, you are entitled to a detention hearing.
